321 Studios, bekend van het programma DVD X Copy, heeft gisteren in de rechtszaak die tegen haar is aangespannen door de Motion Pictures Association of America (MPAA), de omstreden Digital Millennium Copyright Act (DMCA) aangevochten. Dit bericht News.com. DVD X Copy kan een volledige kopie maken van DVD's, zelfs als deze beveiligd zijn. Naast het feit dat 321 hiermee volgens de MPAA copyrightschending mogelijk maakt, zou het bedrijf ook de DMCA overtreden, omdat deze het omzeilen of kraken van beveiligingen verbiedt. Het softwarebedrijf stelde aanvankelijk dat dit onjuist was, omdat iedere DVD-speler de CSS-encryptie decodeert voordat de film wordt afgespeeld. DVD X Copy zou volgens de makers van die gegevensstroom gebruik maken voor het maken van de kopie.
Het bedrijf heeft zijn verdediging echter uitgebreid, door te stellen dat DVD X Copy ongeacht het werkingsmechanisme legaal is. Volgens 321 zouden consumenten in bepaalde gevallen het recht moeten hebben beveiligingen te omzeilen, bijvoorbeeld voor het maken van een backup. Als de rechter 321 hierin gelijk geeft, zou dat dus grote gevolgen kunnen hebben voor de toepassing van de DMCA in de toekomst. De filmstudio's zijn zich hier terdege van bewust en blijven vasthouden aan de stelling dat het maken van een backup altijd illegaal is, ongeacht het doel van de gebruiker:
"Any copies that are made by a user are infringing and not permitted whether they are making back-up copies or extra copies," said Russell Frackman, who is representing the studios. He added, however, that the position could change if better antipiracy technology were created in the future.[...] But 321, in arguing that its products are legal, is also arguing that the DMCA must be reined in. "The court is going to have to come up with a new, nuanced interpretation of the statute," said 321 attorney Daralyn Durie
Het is nog onbekend wanneer de rechter uitspraak zal doen in de zaak.

MasterCard is also testing its PayPass technology in Orlando, Fla., in a trial that involves next-generation credit cards rather than the Nokia phones.
