Al deze copyrights en patenten zijn in door IBM onder de GNU GPL licentie aan de open source community, dus ook aan SCO en Linux, released.
In antwoord op de huidige SCO's FUD campagne heeft IBM de volgende punten voor de rechter gebracht.
SCO Scheme
50. SCO devised a scheme to profit from the Unix assets that it acquired from Orginal SCO, though those assets were in no way developed by SCO. Althrough most, if not all, of the AT&T Unic technology that SCO purports to own is generally known, available without restriction to the general public or readily ascertainable by proper means, SCO undertook to create fear, uncertainty and doubt in the marketplace in regard to SCO's rights in and to that technology.
51. Recognizing that there is little value in its Unix rights, SCO did not limit its scheme to that technology. Rather, SCO devised and executed a plan to create the false perception that SCO holds rights to Unix that permit it to control not only all Unix technology, but also Linux -- including those aspects generated through the indepented hard work and creativity of thousands of other developers and long distributed by SCO itself under the GPL.
52. SCO undertook to carry out its scheme by, among other things, (a) bringing baseless legal claims against IBM and threatening to sue other companies and individuals, (b) conducting a far-reaching publicity campaign to create the false and/or unsubstantiated impression that SCO has rights to Unix and Linux that it does not have and that IBM and others violated SCO's rights and (c) otherwise seeking to condition the market to believe that SCO has rights to Unix and Linux that it does not have and cannot properly enforce.

Juiste deze drie punten in de aanklacht verworden, mijns inziens, de instelling van SCO, de laatste maanden. Het proberen om zoveel mogelijk onzekerheid te creeren, waardoor (a) de rechtelijke macht voordat de rechtzaak, zijn aanvang in april 2005 neemt, al aan het twijfelen word gebracht en (b) er misschien enkele bedrijven zijn die omdat ze twijfelen enkel SCOSource licenties zullen aanschaffen.
In ieder geval behalen, de directie en de eigenaar van SCO, de
Canopy Group• , één beoogd doel, namelijk de stijging van de SCO aandelen. Die men dan ook al weer voor de tweede keer dit jaar in de verkoop doet.
"We have authorized capital of 45,000,000 shares of common stock, par value $0.001 per share, and 5,000,000 shares of preferred stock, par value $0.001 per share. As of September 11, 2003, we have 13,976,731 shares of common stock and no shares of preferred stock issued and outstanding. Our board of directors has authority, without action or vote of the shareholders, to issue all or part of the authorized but unissued shares. Any such issuance will dilute the percentage ownership of shareholders and may dilute the book value of our common stock. . . . As of September 1, 2003, we have issued and outstanding options to purchase up to 3,602,551 shares of common stock with exercise prices ranging from $0.66 to $59.00 per share."
