Netscape aangeklaagd ivm 'afluisteren' van downloads

Dit keer is het de Netscape Smartdownload feature die wat info doorstuurt naar de maker. De locatie, bestandsnaam en een uniek ID worden doorgestuurd naar Netscape.

Hoewel Netscape zelf geen commentaar gaf, staat er in de FAQ te lezen dat er info wordt doorgestuurd om evt informatie te geven over een bepaalde download, maar dat deze info niet bewaard wordt. Als je er vanaf wilt, schijnt het in de Advanced Setup uitgezet te kunnen worden.

A class action lawsuit filed June 30th in a federal court in New York accuses Netscape and its parent company America Online Inc. of electronically eavesdropping on communications between website operators and the visitors who download files from them.

The complaint was filed on behalf of lead plaintiff Christopher Specht, a photographer who operates the lawphoto.com web site. It alleges that Smartdownload transmits back to Netscape the name and location of any filed transferred using Smartdownload, along with a unique identifier. It does all this, according to attorneys representing the class, without knowledge or permission of the webmaster or browser user, and that constitutes a violation of both the Computer Fraud and Misuse Act and the Electronic Communications Privacy Act.

Netscape officials were not available for comment. But according to a list of frequently asked questions at the Netscape site, the back-channel information transmission appears to be part of a feature the company calls SmartDownload Profiling and is designed to enable Netscape to send customized information about a file the user is downloading. According to the FAQ, not only is the uploaded information not saved, but the feature can also be disabled through the advanced set-up button on the SmartDownload program.

Plaintiff's attorneys want a jury trial, an injunction against AOL-Netscape, as well as statutory damages of $100 per day or $10,000 per user, whichever is greater.

Ehhh, ja. Dat soort dingen zou ik toch echt in de logfiles van onze gateway kunnen zien. En als ik er niet naar zou zoeken, dan heeft vast ooit een of andere Linux-freak ofzo dat wel gedaan.
Microsoft is er destijds ook op betrapt (dat was van voor WindowsUpdate Sampoo).

Bijvoorbeeld als je Netscape zelf download, krijg je een kleine executable, die voor jou Netscape download. Het is niet zo dat voor iedere download in Netscape dat programma gebruikt wordt.

Dit is niet helemaal het geval GREENSKiN:
Smartdownload kan ook (optioneel) gebruikt worden voor downloads van andere programma's, en wordt dan dus niet alleen gebruikt voor de download van Netscape zelf, maar voor alle downloads die je doet.

Als je je geld niet op een eerlijke wijze kan verdienen (goede browser leveren) dan maar op een smerige wijze. Ik had altijd wel een klein beetje respect voor de inzet van netscape tegen microsoft opnemen is een zware taak van mij mag netscape nu wel failliet stelletje eikels de paar gebruikers die je toch al had raken ze wel zo kwijt keep up the bad work
